Major Hurdles for Enforcement Community
NFPA 1124 is the Code for the Manufacture, Transportation, Storage, and Retail Sales of Fireworks and Pyrotechnic Articles in which the Council has taken a major stance on March 13, 2014 and issued a lengthly decision on the embattled code to withdraw the fire protection standards for the storage and retail sales of consumer fireworks. This includes specific direction to other standards to “expeditiously remove references to and extracts from the consumer fireworks provisions of NFPA 1124”
In 2007 specific requirements where set forth to maintain the protection requirements that relate to the storage and retail sales of consumer fireworks. the issuance of the 2013 edition continued and now will be modified at the direction of the council to exclude storage and retail sales of consumer fireworks.
The conclusion states:
….. The Council, in particular, is mindful of the enforcer community’s interest in having NFPA develop and maintain these standards. Indeed, it was this interest that promoted the Council and the NFPA Board to entertain the possibility of having NFPA develop these standards despite the NFPA’s strong institutional policy against the use of consumer fireworks.
….Even when, four years later, the consumer fireworks interests failed to fulfill the sprinkler validation conditions set forth by the Council for the continued issuance of consumer fireworks profession…
The document truly lays out the history of the debate and requests of the consumer firework interest to test and develop sprinkler criteria, the petition with ANSI has forced NFPA to render a decision. One of the strongest statements is:
Nevertheless, as we have repeatedly said, the Standards Council does not subscribe to the view, without qualification, that the development of a standard by NFPA is invariably better then no NFPA standard. The Council, after fifteen years of sustained effort, has reluctantly concluded that there should be no NFPA standards for the storage and retail sales of consumer fireworks.
